Understanding subject-to-sale offers

Questions to ask when buying your next home depends on selling your current one.

Robyn’s take · Practical advice

Identify what the condition needs to do

If you need to sell before completing a purchase, the offer must address that dependency clearly. The exact wording and deadlines matter. Have your real estate professional and legal adviser review the proposed terms for your situation.

Understand the seller’s position

The seller will consider how likely your sale is to happen, the timeline and other offers. Your property’s pricing, preparation and market exposure become part of the conversation. Avoid treating a condition as a guarantee that the purchase will work out.

Ask about every deadline

If the offer includes a clause that lets the seller consider another offer, ask what notice could trigger, how much time you have to respond and what financing you would need. Do not remove a condition before understanding the consequences.

Have a backup plan

Discuss the possibility that your sale takes longer or the purchase does not proceed. Keep the budget, deposit arrangements and moving dates tied to the signed agreements. This article is a starting point for professional advice, not contract wording.
